1. Acceptance of Terms

By accessing or using the PR Delivery platform, available at https://prdelivery.com, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you must not use our services.

2. Service Description

PR Delivery is a food delivery marketplace platform that operates in Puerto Rico. We connect consumers with local restaurants, facilitating food ordering and delivery to your door or for pickup. We act as an intermediary between you and participating restaurants.

3. User Accounts

To place orders, you must create an account providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your password and access credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that your account information is current and accurate

We reserve the right to suspend or cancel accounts that violate these terms.

4. Orders and Payments

When placing an order through PR Delivery:

• Displayed prices include the cost of food as established by each restaurant
• Additional charges for delivery, dispatch service and taxes (IVU) will apply as appropriate
• Payment is processed at the time of order confirmation
• We accept credit/debit cards (processed by Stripe) and ATH Móvil
• Prices may change without prior notice and are subject to availability

5. Delivery Policy

Regarding deliveries:

• Delivery times are estimated and may vary depending on traffic conditions, weather and demand
• It is your responsibility to provide an accurate delivery address and be available to receive the order
• Delivery rates are calculated based on distance and may vary by zone
• Some areas may not be within our coverage zone
• For pickup orders, you must pick up your order at the indicated time

6. Cancellations and Refunds

Our cancellation and refund policy is as follows:

• Cancellation before preparation: Full refund if the restaurant has not yet started preparing your order
• Cancellation during preparation: Partial refund or no refund, depending on the order status
• Order issues: If you receive an incorrect order or one with quality issues, contact customer service immediately
• Non-delivery: Full refund if the order cannot be delivered due to reasons attributable to us or the restaurant

Refunds are processed to the original payment method and may take 5 to 10 business days to reflect.

7. Tips

Tips are optional but appreciated. 100% of tips go directly to the delivery drivers. You can add a tip during the payment process or after receiving your order.

8. User Conduct

By using PR Delivery, you agree not to:

• Provide false or misleading information
• Use the platform for illegal purposes
• Interfere with the normal operation of the platform
• Harass or treat delivery drivers, restaurants or service staff disrespectfully
• Place fraudulent orders or use unauthorized payment methods

9. Limitation of Liability

PR Delivery acts as an intermediary between consumers and restaurants. We are not responsible for the quality, safety or legality of food prepared by restaurants. To the maximum extent permitted by law, PR Delivery will not be liable for indirect, incidental, special or consequential damages arising from the use of our services.

10. Intellectual Property

All content on the PR Delivery platform, including but not limited to text, graphics, logos, icons, images and software, is the property of PR Delivery or its licensors and is protected by applicable intellectual property laws.

11. Modifications

We reserve the right to modify these Terms of Service at any time. Changes will take effect immediately after publication on the platform. Continued use of our services after any modification constitutes your acceptance of the new terms.

12. Applicable Law

These Terms of Service are governed and interpreted in accordance with the laws of the Commonwealth of Puerto Rico and the federal laws of the United States of America. Any dispute arising from these terms will be subject to the exclusive jurisdiction of the courts of Puerto Rico.
